Re: need help fixing my credit

Under Virginia Code Section 8.01-454, the judgment creditor has thirty days in which to have the satisfaction of judgment docketed. If he fails to do so within ten days of a written request by the judgment debtor, he can be liable for a fine to the court of up to $50. The judgment debtor is responsible for the cost of the release of lien if any.

File a written notice of motion in the court in which the judgment is docketed to be heard more than ten days from the date of filing. Ask the Court to enter the satisfaction of judgment on the docket. Send notice to the judgment creditor at the address shown in the Court's file, and get a certificate of mailing from the post office (not certified mail, just a receipt showing you sent the mail). Bring proof of payment with you to the hearing. If the judgment creditor hasn't cleared the matter up before the date of the hearing, he's going to be liable for the fine, and also your attorneys' fees (at the discretion of the court).
