Legal Question in Credit and Debt Law in Virginia

garnish ss disability

I got a warrant in debt from a credit card company($4000.00) I can't take bankruptcy (hasn't been 6 years). Can they garnish my social security disability payments (the only income I have)? Also can they come after my home (I inherited it free and clear 3 years ago) or can I protect it? With no job and a horrible credit rating I don't know if I could get a loan, or how I could repay it...my medical expenses are high...

Re: garnish ss disability

Social security disability payments cannot be garnished. The free and clear home would be subject to attachment. You may want to consider Chapter 13 bankruptcy (not subject to the 6-year rule) to allow you to pay this debt over time and thereby protect your house, if, of course, you can't get the creditor to accept a payment plan.
