Legal Question in Credit and Debt Law in Virginia

Garnishment Hearing

My wages are being garnished. Is it benificial for a garnishee to attend the upcoming garnishment hearing. Can the garnishee contest anything at that time, the interest, fees, continued hardship?

Re: Garnishment Hearing

A garnishee is the term which refers to the one (person or entity) who has property or money belonging to a debtor who in turn owes a judgment creditor an amount which is being collected through the remedy of garnishment. The garnishment is therefore served upon the garnishee in order to withhold and pay over to the judgment creditor the amounts permitted under the law which are owed to the judgment debtor(employee of garnishee in your case).

The judgment debtor could attend the hearing on the garnishment to attempt to settle the debt with the creditor by some other means (acceptable to the creditor) or to contest any amounts being unlawfully withheld (exceeding 25% of net salary after all mandatory deductions in the case of the garnishment of wages).
