Legal Question in Credit and Debt Law in Virginia

garnishment Virginia

Can anyone tell me the rules for garnishing a bank account. I am trying to find out if the rules about pay apply.

I have a former tenant who has a bank account and receives a monthly allotment from the government that goes directly into a bank account. It is approximately $650 a month. Does anyone know if this can be garnished and what percentage. It costs $84 to put a garnishment in motion here in Virginia Beach. I do not want to invest more in this if the amount is not enough to garnish.

Thanks,

Re: garnishment Virginia

The first rule to consider is whether you're certain that you've first obtained a valid judgment against your former tenant, without which no summons in garnishment may issue.
