Legal Question in Credit and Debt Law in Virginia

How do I handle this debt collector?

This afternoon, there were two messages left on my answering machine by a company claiming to be a ''legal firm''. I was told to return the phone call within 48 hours or legal action would be taken against me. Also, they called my brother at his home and informed him that they are debt collectors from Capital Management. They lied to my brother and told him fraudelent things about me. I then called this company back, and they said that they're trying to collect an old debt from Sears. They said that they bought the account from Sears and are now collecting it. When I asked them for a name and address, they refused, and they informed me that all communication is only done through fax. I have several concerns. First, this debt from Sears has been inflated considerably. Also, the debt is very, very old, and it was written off by Sears. Secondly, it bothers me tremendously that they called my brother and lied to him about several points. I don't want them saying any more lies about me. Thirdly, I don't want to be taken advantage of, and this cleary seems suspicious to me. I don't know what to do. Do I have any rights in a case like this? What do I do?

Better arrange for a consultation with an attorney who understands debt collection law and your rights as a consumer under the federal Fair Debt Collection Practices Act(FDCPA).
