Harrassing Credit Collections
my husband is being harrassed for a debt that is not his. The debtor has the same name as him. We thought we had resolved the problem a few years ago with Capital One - who assured us they would remove his name from their collecitons list, however they have sold this receivable to a collection agency who is rudely and doggedly screaming at us & harrassing us. They have threatened to call us every day until we pay this debt that is not ours & will not accept any explanation except my husband's social security number which we refuse to give to them. How can we put an end to this? We are home owners with an excellent credit rating and do not deserve this harrassment. Shouldn't they verify they have the right person before pursuing someone?

It's probably time for you to retain the services of an attorney to sue the SOB's(meaning Capital One as well as their apparent successor in interest)under the FDCPA(Fair Debt Collection Practices Act)and any other applicable statutes for your damages, not merely compensatory, but, perhaps, punitive as well, as the law and facts may warrant.
