Legal Question in Credit and Debt Law in Virginia

Hospital Debt

My Fiance had 3 surgeries on his ankle in november of '07- he did not have medical insurance so now he owes 3 separate bills for a total of about $45,000.00. They want to garnish 15% of his paycheck for each bill- totaling 45% of his entire biweekly paycheck...We haven't gone to court yet but what could we do to make sure this does not happen? Please help us!

Re: Hospital Debt

Garnishment amounts in the Commonwealth are limited to no more than 25% of a debtor's net salary(irrespective of the number of garnishments), and when your fiance's employer receives the paperwork from the court to begin the withholding, he may wish to remind them of this legal factoid.
