Legal Question in Credit and Debt Law in Virginia
My ex husband contacted me yesterday and told me to be expecting a warrant for my arrest this week. He says that he is filing credit card fraud through the court/Police Department. Last year when we were separated and I was out living on my own, I used his credit card number two times to pay two bills without his knowledge. Well, the amounts were both blocked and it was never charged to his card so therefore, I had to pay my two bill companies the next month even more money. Well, he says that there will be a warrant for my arrest this week for credit card fraud since I attempted to use his card online. Would the police just show up at my house and arrest me without even interviewing me and taking me to court? This just seems odd. What else can I do on my part to help this situation? There is no balance that I owe on the card.

Yes, I've known of a similar situation where a spouse was criminally charged (spouses were separted and one used the card of the other without her permission).
However, it will not be up to your husband to determine whether the same could happen to you in the situation described but rather the local prosecutor's office. And, yes, if you're criminally charged with a felony,
the cops could just show up with a warrant for your arrest if they chose to
go about it in that manner.
However, until the matter is resolved, you should discuss it with no one
except your lawyer if you should need to hire one.
