Legal Question in Credit and Debt Law in Virginia

Insurance Company Error

I had surgery on 3/31/06. My insurance never correctly paid anestesia. I faxed Aetna 4 times and they never responded. Finally after getting a collection notice I called Aetna and they have paid the bill in full. Can I still be charged the collection fees and have my credit affected? Isn't Aetna the responsible party?

Re: Insurance Company Error

No, you should not be charged collection fees nor have your credit adverely affected. This incident apparently was Aetna's mistake which undoubtedly happens quite often.

If anything adverse does appear on your credit report in regard to this incident, you should provide your own statement(up to 250 words) as to what occured and, perhaps, request that the hospital/doctor who wasn't timely paid, make a request to the applicable credit reporting agency that it be removed.
