Legal Question in Credit and Debt Law in Virginia

issue with mechanic lien

We hired a business to paint our house; he quoted us $35 hour. He showed up w/another man and at the end of the job told us the total was $70/hr. for 7 hours. I initally wrote the check not being sure if my husband had understood something differently. We asked that they send a bill and receipts for purchased paint. After 1 1/2 weeks w/no response I cancelled the check- my husband also told me we were quoted $35/hr. The company contacted me and asked why I cancelled the check- I told them that they had never sent the bill, the receipts for product and that we had agreed to $35/hr. When she finally sent the bill it stated they had a $30 returend check fee- this was after I'd cancelled the check- so they were still trying to collect $70/hr. plus that. There was no payment due date nor any interest rate on late payment. Since then they've filed a mechanic's lien charging us interest from the day of work (it took 2+ weeks to get a bill) plus everything else. What recourse do I have?

Re: issue with mechanic lien

You could file papers with the court where the mechanic's lien is recorded to have the lien removed for the reasons which you've outlined here in your question.
