Legal Question in Credit and Debt Law in Virginia

Items paid for and not yet delivered

In August, 2000, I purchased a workstation by phone and my credit card was charged the next day. Delivery was promised on September 18, then changed to December 4. I have tried to reach the company by e-mail and phone. As of 12/11/00 all the lines are busy and the customer service mailbox is full and cancelled. What to do? What are my options? I would like the furniture since I've paid for it, but can't reach company. How can I get my money back? Thanks.

Re: Items paid for and not yet delivered

Immediately call your credit card company and ask for a credit. Send a letter describing why within 30 days or whatever they require (probably sooner). I believe they will then take money out of the merchant's account, normally, to hold in escrow pending resolution of the dispute.

A day or so after you tell the credit card company to give you a credit, call the merchant and tell them that you still want the goods but you don't want to pay until they either deliver or at least tell you that they are shipping, ... is that okay?, you ask. You offer to commit in writing.

I'm not sure what else you can do.

For the credit card company, the statement is simple: "goods ordered on xxxx date; nothing delivered as of today."
