Legal Question in Credit and Debt Law in Virginia

judgement against debtor

If someone has a judgement against them and they buy an auto, the auto can be taken to pay the debt. What if the auto is leased? Can it be taken?

Re: judgement against debtor

Yes, the car can be taken to satisfy the judgment if it is owned by the judgment debtor, although the purchase money loan would have to be satisfied first out of the proceeds of the Sheriff's sale. If it is leased (on a typical lease), it cannot be taken.
