Legal Question in Credit and Debt Law in Virginia
judgement
My husband had health insurance from a company in Maryland. This was a policy in his company name and carried several employees. The premium was a direct withdraw from the business checking account. As premiums kept rising he eventually canceled the policy and the business closed shortly after. Almost 10 years later, we just had a phone call from someone trying to give us judgement papers from this insurance company saying there was a few hundred dollars still owed and now with interest and attorneys fees its over 3000.00. What should we do? I am not sure if we still have all these records from the old business. Can this be a scam? I thought for a judgement we would get something through the courts or deputy sherriff. Help?

Re: judgement
It's probably not a typical scam, but unless it was filed years ago and they were only able to find and serve you now (and got any necessary extensions of time from the court to do so), it's likely that it's barred by the statute of limitations. You need to assert that as a defense, though, or judgment will be entered against you.
