Legal Question in Credit and Debt Law in Virginia

Judgment-homestead exemption

I currently have a judgment against me for $1,600 but I want to use VA's homestead exemption to prevent any garnishments or bank seizures. I know the exemption is up to $5,000, but what do I write on the homestead form and what do I say to the judge during the exemption hearing?

Re: Judgment-homestead exemption

Your homestead exemption from garnishment of wages is outlined in Va. Code Section 34-29, i.e,

no more than 25% of your disposible income. With respect to bank account funds there is, apparently, no such limitation.
