Legal Question in Credit and Debt Law in Virginia
Lien
Can a lawyer I fired on the advice of his replacement for not doing anything for me - not showing up for depositions, missing deadlines, fee padding, etc legitimately obtain a lien against my home without my knowledge or consent? The lawyer won a judgment against me but after I filed a complaint against him with the Virginia State Bar I received a note from the senior partner of his law firm they would stop harassing me about the loan.
I only found out about this lien years later when my husband applied for a loan against our house. How do I obtain a release from this lien? Where do I get the information about this lien to begin obtaining a release? I don't even know where that lawyer is and his law firm appears to have been dissolved.

Re: Lien
Only the firm or its representatives or successors in interest, would have the legal authority to authorize release of this lien(absent an order from a court authorized to hear and rule on the matter). The lawyer who obtained the judgment against you was then entitled to encumber your property
by filing a lien against it which did not require either your knowledge or consent. (Sometimes the recorder of such a lien will send the judgment debtor a copy of the filed lien, but not necessarily.)
