liens

a hospital from another state has filed judgement against our personal property in this state for neccessaries.[heart attack] can that lien be removed from our property? our laws says no lien or judgement can be placed against a principal residense for neccessaries-state law 55-37 or if its repugnant to the laws of the commonwealth. i can not afford an attorney at this time. what could i do thank you.--

The judgment can be enforced against both husband and wife, and the property of both, if it is for necessaries. The only exception is that in VA, real estate held as tenants by the entireties, which can normally be taken to satisfy judgments against both spouses but not against just one of them, cannot be taken if the basis for the judgment being against both spouses is the doctrine of necessaries. Wages and personal property of both can still be attached.
