Legal Question in Credit and Debt Law in Virginia

Loan write off

I have a loan that was written off by the company 3 years ago. Now I am being taken to court by a collection company. It also states on my credit report twice that this loan is a write off. My husband had a stroke 3 years ago and I had an accident which left of both disabled. I know thay cannot touch our disability. But can they go after my checking account and can they win in court for a judgement?

We need more facts. You may have a claim under the Fair Credit Reporting Act and/or the Fair Debt Collection Practices Act. Feel free to contact me if you need help or a referral. Good luck.

Re: Loan write off

Yes, they could go after your checking account but only after they first obtain a valid judgment against you.
