A husband takes out a home equity loan and signs his wifes name for said loan without informing his wife of the loan? Is this leagl? and if not what can the injured part do?

It is not legal. Tell the company that provided the loan and they will take it from there.

This is not legal--it is forgery. The injured party might want to discuss this with an attorney as soon as possible to avoid further potential liability.
