Legal Question in Credit and Debt Law in Virginia

question for ya

my estranged father passed away

recently, and a former girlfriend of

his was named beneficiary to his ira

and life insurance policies. my

question is who is responsible for all

of his debt, me? next of kin? and if i

am responsible can i sue the former

girlfriend for the funds she is

receiving to pay for the debt?

You should not be personally liable for your father�s debts. His estate is responsible. This means, for the most part, that the creditors get the first crack at any probate assets a person leaves behind at death. However, IRAs and life insurance policies are not subject to probate.
