Legal Question in Credit and Debt Law in Virginia

Responsibility after parents' deaths

Father has passed. Mother close to it. High debts. Have power of attorney, but am not coholder on any accounts. Mother resides in North Carolina but I use my address in Virginia for her bills as it is POA address. Will any of her creditors have recourse against me personally after her death?

Re: Responsibility after parents' deaths

No, the creditors will not have recourse against you even if you're the personal representive or executor of your mother's estate. They will, however, have such recourse against your mother's estate, such as it may be---- at least with respect to filing their claims.

Your current power of attorney does not confer any personal liability upon you for your mother's

debts but merely provides legal authority for you to act in her behalf.
