Legal Question in Credit and Debt Law in Virginia

Service - Garnishment

I received a Judgement for Wage Garnishment from a Creditor in Aug. I have been paying since. What is the proper form of service?

I was only made aware of the Garnishment by the time it made it to my payroll department. Furthermore, the court papers show my former address although my current address is publicly listed. I have a court date in January. Is there anything that I could do now?

Thank you for your time.

Re: Service - Garnishment

If you believe that money is being improperly withheld from your wages as a result of a garnishment, you should notify the garnishor as to the basis for your objection. Otherwise, if it's the result of a judgment that was validly obtained against you by one of your creditors, about all you can do is keep a careful record of the amounts that have been withheld, making sure that none exceed 25% of your net salary from any given paycheck(after all required deductions)which is the normal legal cap on wage garnishments in Virginia, and then bring this information to the court hearing scheduled in January, the purpose of which is unclear to me.
