Legal Question in Credit and Debt Law in Virginia

small claims court action

I recently filed a warrant in debt against a corporation in stafford va. I listed my husband and I as plaintiffs and the defendent was listed as ABC, Inc, C/O John Smith at 123 Main Street, Stafford, VA. The warrant in debt was served not at the address I listed but at a different address. The judge said it was a problem since it is a corporation and the warrant was served at a different address than I had listed. (The registered agent lived at that address; however he and his wife are separated and he moved to the address where the warrant was served). The judge said to refile with a different address. John Smith is the registered agent and the address I had listed is what is listed on the corporation papers. Which address do I list? How can I prevent the deputies from serving it on a different address? What is the correct form I fill out to sue a corporation?

Re: small claims court action

Not sure which corporation papers you mean. Seems you did this properly. May be the address and/or name are indeed wrong. Call the State Corporation Commission and tell them what is going on, and get the current address and name of the registered agent.

Good luck.
