Legal Question in Credit and Debt Law in Virginia

small claims judgement

My wife was sued by an individual in small claims court for an unpaid personal loan and now has a judgement against her. My wife does not work and has no assets but has been trying to work out a payment plan with this person. The claimant has now filed a small claims action against me in order to garnish my wages even though this is not my debt. Is she allowed to do this?

Re: small claims judgement

Anyone can sue for anything, but they should not win if you did not borrow the money.
