statute of limitations for filing a judgement

Someone rented a car from a rental company and wrecked it. There was $1100 worth of damage. They waited 5 years and a week to file judegement. Is this legal. The state was Virginia

The statute of limitations on written contracts in the Commonwealth is five years from the date of the breach of the contract(not the date it was signed).

You may possibly have your dates confused and the rental car company has actually filed their suit for damages within the permitted time period.
