Legal Question in Credit and Debt Law in Virginia
Statute of Limitations
I have a question about the statue of limitations in VA on collections. How long does a company have to try and collect a debit? For instance there was a check writtin on my account a long time ago and they are still trying to collect. Don't they only have a couple of years to try and collect?

Re: Statute of Limitations
The statute of limitations on a bad check is 4 years. If the underlying obligation was based on a written contract, suit on that could be brought in 5 years. These are general principals, and the specific facts determine what limitation period applies, when it begins to run, and when it is tolled.
