Legal Question in Credit and Debt Law in Virginia

Statutory Guidelines for bad checks

Can a creditor(law office) collect 3 times the amount on a return check? I paid the the amount of the check. However, the legal group says I need to pay $100.00. They said a letter was mailed out to inform me of the statutory guideline. I never got the letter and they told me it was sent to an address I haven't lived at in 5 years. I have been at my current residence for 2 years now. Should I fight this, or pay the fee and move on?

Re: Statutory Guidelines for bad checks

You say that you "paid the amount of the check."

The question is when. If you mean that you recently made good on a check that bounced years ago, you should remit immediately the amounts being requested (and count yourself lucky that criminal charges haven't been filed).

However, if you're suggesting that you actually

made good on the check within five days of receiving notice of its "rubbery status", so to speak, according to statutory guidelines, then you would have no obligation to pay the triple amount which is being requested and that, apparently, includes penalties and interest.
