Legal Question in Credit and Debt Law in Virginia

sued over credit card debt

I have been out of work and only making payments on my mortgage. I recvd letter from capital one (and i'm sure more will follow) saying they are charging off debt but will take legal action if I don't send pymnt in full. I don't have any $ to send. I only have 10 days to respond (live in VA). What should I do? if I make pymnt agreement & i don't have the $$ what happens then?
