Legal Question in Credit and Debt Law in Virginia

Surprise debt

In December 2003 I received a notice of debt from a lawyer for a medical bill from December 2000. I had no knowledge of the debt. I was a paying patient at the office up to June of 2001 and was never informed that there was a past due balance. I moved to NC in Nov. 2001 and left a postal change of address but their billing dept never contacted me. Is there a ''contact'' procedure they're required to follow before they send my account to a lawyer and am I responsible for interest and lawyer fees?

Re: Surprise debt

The real issue is whether in fact you were properly charged for a service which you in fact received but haven't, for whatever reason, paid for. If so, and the reason you haven't paid for it is that you never received a bill, perhaps, you can now negotiate a lesser amount that will mostly eliminate the interest and lawyer's fees.
