Legal Question in Credit and Debt Law in Virginia

Unethical Sales Tactics

I brought a used car in VA and I already had financing when I went to the dealer. I told the salesman I wouldn't be financing with them and not to check my credit. He told me he needed my SSN for the purchase deal, which is why I gave it to him. Unkown to me until after I had paid for the car. The dealer checked my credit without my permission and tried to get financing with another company they finance through, although I repeatedly asked him not to and gave my SSN to him for the purpose to buy the car not finance it.

What can I do? The finance co. they tried to use turned me down and this will be reflected negatively on my credit.

Re: Unethical Sales Tactics

What you can do is probably sue them for violations of the Fair Credit Reporting Act. From your facts stated it sounds like your credit report was impermissibly accessed by the dealer. That is a cause of action, even if your credit is not negatively impacted. You should get a copy of your credit reports. One copy a year is free to Maryland residents, or if you have been denied credit, which you indicated happened. - Michael C. Worsham, [email protected].
