Warrant in Debt ?

Someone close to me is in a similar situation.Had a credit card debt, that they could not pay as their house got burglarised and along with that all their credit cards, tax returns, social security numbers got stolen.This couple tried contacting all the banks they had been dealing with.This one credit card company was not very co-operative in settling the o/s balance.Balance was transferred to 3 different collection agencies.All this couple wanted was a statement of account to come up with a payment plan.Now 2 years later there is a warrant of debt against them.What can they do to resolve this matter ?

They can try to settle or defend the case. There should now be a lawyer involved, who will have to provide a "bill of particulars" stating the basis for the claim, and then prove the case. You can ask for whatever you want from him/her, and while s/ doesn't have to provide it, you can refuse to settle unless s/ does. If it is not provided, chances are it can't be, and if it can't be, chances are they can't prove their case. A lawyer experienced in these matters could help.

They deserve a statement of account and written confirmation of the debt, which they should request.

They should consult a good consumer law attorney ASAP.
