Legal Question in Credit and Debt Law in Virginia

Warrant-In-Debt

I'm an entertainer, living in Virginia, who was stiffed for a performance fee of $600 by a club in Ohio by way of a bounced check. In your opinion, would a warrant-in-debt be the best, or only means at my disposal to try and collect?

Re: Warrant-In-Debt

A Virginia warrant in debt would be unlikely to work against a defendant in Ohio due to likely problems with service of the papers(notice to the defendant of the lawsuit) and then with enforcement of any Virginia order which you might receive.. The better apporach would be on your next trip to Ohio to file your claim in the appropriate Ohio small claims court.

(The foregoing assumes that the Ohio club is not part of any firm or company which does business in Virginia or that has assets in the Commonwealth.)
