Legal Question in Criminal Law in Virginia
i am 18 and was charged with underage consumption . i did not give the officer a hard time , i complied with all his orders. i have a court date next week and i dont want this on my record. how do i ask for a deferred adjudication or pre-trial diversion ? i live in virginia... i was NOT caught driving .

Va. Code Sec. 4.1-305 F describes how a person with no
prior convictions can qualify for deferred proceedings and be placed
on probation, which if successfully completed, will allow the person
to emerge from the case without a record of conviction.
Look it up, make a copy of the provision cited, and take it to court
with you and tell the prosecutor before your case is called that this is
the disposition that you would like to have.for your case.
