Legal Question in Criminal Law in Virginia

In 2004 i was employed with my state Social Service dept. We had a hurrican and administered state disaster assistance. Employees were allowed to apply as well. I applied and revcd asst. However, turns out, my ex husband (not ex at the time) applied also, but had someone else falsely use my name and info with a diff address. When i found out abt it was when i was stop for a speeding ticket, a warrent was out for my arrest and i was arrested and chge with a felong $450 was the amt of the assistance. When i realized what had happened, my husb was incarcerated at this time, the lawyer suggested i just pay it and move on so he wouldn't serve additional time! I paid it, but it is still on my record and i am afraid to apply for social service jobs (which is my degree) or any other jobs! How can i get this expunged!- state= virginia

Big mistake to "just pay it and move on" since although you may

have thought you're moving on, your record of felony conviction is coming

right along with you.

And, no, unless you can demonstrate that you were wrongfully convicted and have received a pardon from the governor, the record of such a conviction in the Commonwealth cannot be expunged. (See Va. Code Sec. 19.2-392,2)
