Legal Question in Criminal Law in Virginia
Me and 3 other friends were charged with Grand Larceny, the total cost was around 510$, Is there anyway that a Lawyer could have the total split among the 4 to prevent the crime from becoming Grand Larceny and degrade it to Petty? We would all still be willing to pay the 510$ each, but we're just curious if it were possible.
1 Answer from Attorneys
Technically if you are accessories (i.e.-accomplices, aiding and abetting, etc. ...) then each of you is just as responsible as if you had taken the entire $510 worth yourself. On the other hand, in most jurisdictions a case like that would be routinely reduced to a misdemeanor for all 4 defendants, assuming reasonably competent attorneys, relatively clean records and no aggravating factors. Being able to pay the entire amount of restitution by the court date always helps.
