Legal Question in Criminal Law in Virginia
2nd degree murder
My son went over to his ex-girlfriends house to ask her parents to have them assist in leaving him alone and giving him his things back. My son knew she wouldnt be there and thought that would be--name removed--since he didnt want to see her. The father got angry at what my son was saying and went upstairs, retreived a 38 special with hollowpoint bullets, came back downstairs, shoved my son a couple times to try to initiate a fight, then when my son tried to defend himself, the man admitted to pulling the trigger and murdering my son. I want some assurance or opinion that the charges are warranted because know the monster wants to try to say self defense. This is in Va. and I was told you could not bring a weapon to a verbal arguement. The monster has admitted to shoving my son first and even said he decided to pull the trigger. Also, the man had hidden drugs in the house and he is a felon, but it was 17 yrs ago. Thank you for anything you can say.
