Legal Question in Criminal Law in Virginia

2nd offense underage alcohol

So, here's the whole story: I'm 19 and I was at my friends bday party, wasn't planning on drinking, bday boy talked me into a few shots so i took some of somethin, don't even know if it was alcohol, they might have just given me somethin to drink with them since i said i didn't wanna drink that night, then about 4 hours later, the police show up and im outside with about 600 other kids, the cop stops me asks if i drank any tonight, i said yes, but can i be breathalized because it's def not in my system, and it might not have even shown up, they just ignored me and then was arrested for ''dip'' and underage drinking. I wouldn't be so worried, but I got underage drinking when I was 17, will this be my second offense?? what is the normal punishment for this?? and with a decent average attorney, can I get this lowered or dropped since it wasn't still in my system??

Re: 2nd offense underage alcohol

Your mistake was admitting to the cop to having consumed alcohol as an underage violator.

Yes, if you're convicted of this particular offense, it will likely be counted as your second offense which carries a fine of $500 with the requirement that the convicted one complete around 50 hours of community service.

Better get an attorney to represent you on this charge to ensure that the possible adverse consequences are in fact minimized.
