Legal Question in Criminal Law in Virginia

2nd time around

this is my husbands 2nd charge of robbery .The 1st was robbery and his new one is Grannd Larceny but the amount was only $98.00 which i think is Petit so why are they charging him with Grand? Is it bc it's his 2nd time?

Grand larceny can be charged any time any thing(whether money or other things) valued at $5 or more is taken by larceny from the person of another.(See Va. Code Sec. 18.2-95)

In Virginia, grand larceny requires $200.00 or more theft. Robbery does not require the same amount. An item can be worth only $5.00 for there to be a robbery. In simple terms - robbery is force/threat/intimidation and any larceny together. A person can receive up to life with a robbery conviction.
