Legal Question in Criminal Law in Virginia
No he didn't because #1 reason is I don't think he was aware that was an option and #2 reason is the judge basically would not let him. He (the judge) said that they were going to proceed because his lawyer (offender) was running late. The defendant began to testify against him splurging lies that did not even make sense.

Well, hopefully, the alleged offender's lawyer will be on time for the trial after which s/he can then make whatever appeal may be appropriate in the case.
