Legal Question in Criminal Law in Virginia
My 16 year old son has been charged with assult and battery and destruction of property. While at a carnival my son was approached by a 13 year old boy who exchanged words with my son then pushed him in the chest. My son swung at him but did not hit him, there are witnesses to this. Later this boy accused my son of damaging his ATV. The police say they have a security video of the persons doing the damage but will not tell me a time stamp from the incident nor allow me to view the video. All they will tell me is my son was identified by the victim and that we will need to pay for the damage. What should we do?
