Legal Question in Criminal Law in Virginia

Arraignment questions

If I choose to drop charges against someone, can I do so at the arraignment? Can I speak to the judge about me wishing to drop the charges? Please tell me what can I do if I made the charge in haste??

Re: Arraignment questions

You can certainly ask the Judge to drop the charges, but it will be up to the Judge whether or not he decides to do so.

Re: Arraignment questions

If you have such concerns, you should be bringing them to the attention of the prosecutor assigned to the case rather than the judge. The prosecutor will make the decision as to whether he or she has evidence sufficient to go forward with the matter. Obviously, if you as the commonwealth's chief witness suddenly are having second thoughts about testifying or copperating in the prosecution of the case, you should make your concerns immediately known to them.
