Legal Question in Criminal Law in Virginia
I was arrested for felony drug possession in Virginia Beach in 2001. I was placed into the First-Time-Felony-Offender-Program and completed it successfully. Upon completion, I was told I could take some steps with the courts o have this offense expunged from my record, but never did. 8 years later I am wondering if I can do this as I am searching for a new job in Pennsylvania. I called the courts and the person I spoke with told me that she doesn't think drug arrests can be expunged. I am looking to get this question answered for free, but if you are a lawyer in the Virginia Beach area that answers this question, I will be happy to use your services for the expungement if possible.

Assuming the disposition of your felony case that you received was something other than a dismissal or acquittal after trial, under Va; Code Sec. 19.2-392.2 et seq., you would not be eligible for the expungement of this offense and it would appear that the court may have misinformed you on this particular issue.
