Legal Question in Criminal Law in Virginia
Why wasn't he arrested? Probation violation-sol question.
My brother was released from prison on a drug charge and he is on 5 yrs. probation. He walked into the middle of a drug bust at his girlfriends house (her brother). My brother was searched and they found small amount of methamphetamine. My brother was never charged with anything, so he had his girlfriend call and ask if he was going to be charged, they said they weren't after the users, just the dealer...Can they change their mind? What is the statute of limitations? Since he is on probation, if they were going to charge him with a violation shouldn't they have already done it? He has had a big life style change since then and is worried this will haunt him.

You give no indication whatsoever in your question as to when this incident occurred, but if
more than a couple of months have passed since the girlfriend called, your brother may have nothing to worry about------particularly, if there's no on-going investigation and whoever the cops were going to arrest have been taken down.
