Legal Question in Criminal Law in Virginia
Assault and Battery
My Fianc has been charged with a misdemeanor assault and battery in the state of Virginia. Her daughter, who filed the charges, wanted to drop them but the court said they cannot.
Also, her attorney (provided by the state) claims she is responsible for the attorney fees and all court costs. Is this true? How much will all this cost -- it seems so unreasonable for a misdemeanor. Also, what happens if she cannot afford to pay?

Re: Assault and Battery
Given the fact that the state approved compensation for the defense attorney is probably only a little more than a $100.00, I doubt that your daughter has much to be concerned about as to the attorney fees. If she loses the case and is convicted of the musdemeanor, she'll likely owe no more than $150 or so in court costs.
Maybe, not so bad a deal after all, wouldn't you agree?
