Legal Question in Criminal Law in Virginia
Assault and Battery
I was recently attacked by a woman in my neighborhood. I swore a warrant out on her, and she was not arrested, just questioned. I then received a court date. However, I find out that my case may be dismissed due to the fact that she is not ''mentally stable''. I consider her a threat to the community, and this has happened before, but she never actually touched anyone else until now. Is there anything I can do to see she is dealt with and no longer a threat to anyone else?

Re: Assault and Battery
You should insist on speaking personally with your elected Commonwealth's attorney for the jurisdiction responsible for the prosecution of
this person and explain your sentiments regarding the situation.
And, I would not, if I were you, be satisfied with
talking to one of the deputies or other assistant
commonwealth's attorneys.
