Legal Question in Criminal Law in Virginia

Assult & Battery

I was recently charged with Assult & Battery, I have a clean record and I am very worried about what will happen at court. I have witnesses that will be there to defend me. I am a full-time student and I work part-time.

What can possibly happen? What usually happens in cases like mine? And what should I expect for punishment if I am found guilty?

Re: Assult & Battery

In regard to your question as to "what can possibly happen?", one answer is that you could be convicted, which is why you should request that the court appoint defense counsel to represent you if you cannot afford to hire one.

Even if you're found guilty, as a first time offender, you should be eligible for what in Virginia is known as an SIS (Suspended Imposition of Sentence), which your lawyer will know how to arrange and which will allow you to escape this run-in with the law without a permanent record of a criminal conviction.
