Legal Question in Criminal Law in Virginia
background check for employment
My son when he turned 18 made a bad judgement and went into Target with a group of others an took a CD worth he said about 9.00. He said he was told that after he completed his time and did his community service it would not show on his record. Now trying to get a job a report was sent to an employee on this issue. It was listed as a mistameanor but it is creating an issue now getting a job. He is 20 now. Can anything be done, and how long will this follow him.

Re: background check for employment
The advice your son received was terribly wrong, nothing can be done, it will be on his record forever and he won't get work, ever.
Re: background check for employment
If your son received the disposition for his case
known in the Commonwealth as a Suspended Imposition of Sentence(SIS), there should be no record of any conviction(only the arrest)if in fact he successfully completed the terms of his probation.
