Legal Question in Criminal Law in Virginia

If I\'m in a boat, my son is driving (he\'s 19) we get stopped by police and I receive a ticket for not having a type 4 throw device and the boat is registered to my brother-in-law should I fight it. The arrest date says 6.22.2009 and the offense date says 6.27.09

So, why didn't the marine cop give the boat driver the ticket--instead of you, a mere passenger?
