Legal Question in Criminal Law in Virginia

Use of a ''Body Wire''

Can the Police transmit and record General Conversation through use of a ''Body Wire'' in a Private Business without a warrant? If the tapes contain conversations in which the officer was not participating, but merely ''Listening'' with no consent of the participants, is the entire tape then not usable for evidence? Do the Police need a warrant prior to conducting ''Body Wire'' investigations?
