Legal Question in Criminal Law in Virginia
my brother wrote 3 post dated checks that did not clear. He never attempted to make them clear. he was sentenced to 2 .5 years. Is that legal in Virginia to go to jail for this?

Yes, quite legal, assuming your brother was convicted of a Class 6 felony, i..e., two or more of these
checks added up to at least $200.00 or more which upon conviction carries a penalty of at least
one to no more than five years in the penitentiary. (See Va Code Sec, 18,2-183.1).
