in a case that a telphone is used but your name is spelled wrong by the company is there anyway to get that evidence thrown out of court

Possibly, depending upon the nature of the case involved and if it was not your phone. However, if the claim for excluding rests only upon the fact of a misspelled name, you can forget it; the evidence is unlikely to be excluded.)
